Welcome to Elimudemy. These Terms and Conditions ("Terms") govern your access to and use of the Elimudemy mobile application, website, and related services (collectively, the "Service"). By downloading, installing, or using Elimudemy, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not access or use our Service. If you are under 18 years of age, you must have your parent or legal guardian read and agree to these Terms on your behalf.
Elimudemy is an educational platform designed to help Kenyan students prepare for national examinations including KPSEA (Kenya Primary School Education Assessment), KJSEA (Kenya Junior School Education Assessment), and KCSE (Kenya Certificate of Secondary Education). Our Service provides:

To access certain features of Elimudemy, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
While students of all ages may use Elimudemy, users under 18 must have parental or guardian consent. Parents and guardians are responsible for monitoring their child's use of the Service.
Elimudemy offers limited free access to sample questions and basic features. Free access does not include the full question banks or advanced features.
To access full features, you must activate your device through a one-time payment. Key activation terms include:
All payments are processed securely through third-party payment providers. We accept M-Pesa, credit cards, and debit cards. You agree to provide valid payment information and authorize us to charge the applicable fees.
Due to the digital nature of our Service and the immediate access provided upon activation, refunds are generally not available. We encourage users to thoroughly test the free version before activating. Exceptions may be made on a case-by-case basis for technical issues preventing service delivery.

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, software, questions, and answers, are owned by Elimudemy or our licensors and are protected by Kenyan and international copyright, trademark, and other intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial educational purposes only.
You may not copy, modify, distribute, sell, or lease any part of our Service or included content. You may not reverse engineer or attempt to extract the source code of our software unless laws prohibit these restrictions or you have our written permission.
While we strive to provide accurate, up-to-date educational content aligned with Kenyan curriculum standards, Elimudemy does not guarantee:
Elimudemy is a supplementary study tool and should not be the sole resource for exam preparation. Students should also use official curriculum materials and guidance from their teachers.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, ELIMUDEMY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
No advice or information obtained from Elimudemy shall create any warranty not expressly stated in these Terms.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELIMUDEMY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

You agree to indemnify, defend, and hold harmless Elimudemy, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses, including reasonable attorney fees, arising from:
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using Elimudemy, you consent to our data practices as described in the Privacy Policy.
You may stop using the Service at any time. However, activation fees are non-refundable.
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Service will immediately cease.
We may modify these Terms at any time. When we do, we will post the updated Terms on our website and app and update the "Last Updated" date. Material changes will be communicated through in-app notifications or email.
Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.
These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the Service shall be resolved through good faith negotiations. If negotiations fail, disputes shall be subject to the exclusive jurisdiction of the courts of Kenya.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely approximates the intent of the original provision.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Elimudemy regarding the use of our Service and supersede all prior agreements and understandings.
